SUBMISSION TERMS
These Submission Terms apply to any audio recording, video recording, photograph, written story, translation, transcription, musical work, performance, historical information, biographical information, or other material submitted to Muslim American Casting LLC, doing business as The Palestinian Folk Music Archive (collectively, the “Archive”).
By submitting materials to the Archive, you acknowledge and agree to the following:
1. Your Authority to Submit
You confirm that you are at least eighteen (18) years old and have the legal authority to make the submission and agree to these Submission Terms.
You represent that you either own the rights necessary to submit the materials or have obtained all permissions reasonably necessary from the applicable copyright owners, performers, speakers, photographers, videographers, family members, representatives, or other persons whose work, voice, image, likeness, personal history, or other rights are included in the submission.
Your submission must not knowingly infringe another person’s copyright, trademark, privacy, publicity, contractual, confidentiality, or other legal rights.
2. Traditional and Cultural Materials
The Archive recognizes that Palestinian folk songs, oral histories, traditional performances, and other cultural materials may have been passed down through families and communities over generations.
By submitting materials, you are not required to claim exclusive ownership over an underlying traditional song, folk expression, historical account, or other cultural material that is not exclusively owned by you. The rights granted under these Submission Terms apply only to the rights that you own or are legally authorized to grant in the particular recording, performance, photograph, text, translation, or other materials you submit.
3. License Granted to the Archive
You retain any ownership rights you may have in your submission. However, by submitting materials, you grant the Archive and its successors, affiliates, service providers, cultural partners, educational partners, and authorized licensees a perpetual, worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to:
- preserve, archive, store, host, digitize, copy, reproduce, and back up the submission;
- publish, display, perform, transmit, distribute, stream, broadcast, communicate, and otherwise make the submission available to the public;
- transcribe, translate, caption, annotate, catalog, index, excerpt, reformat, restore, enhance, or edit the submission for length, clarity, accessibility, preservation, technical compatibility, or presentation;
- incorporate the submission into the Archive’s website, databases, exhibitions, educational materials, research projects, publications, documentaries, presentations, social media, fundraising materials, promotional materials, and other archival or cultural programming; and
- exercise these rights through any media, format, platform, or technology now known or later developed.
This license may be exercised throughout the world in connection with the Archive’s preservation, historical, cultural, educational, research, exhibition, promotional, fundraising, and related activities.
4. Names, Voices, Images, and Personal Histories
You authorize the Archive to use and publish any names, voices, images, likenesses, biographies, family histories, locations, villages, dates, contextual information, and other identifying information included in or provided with the submission.
You confirm that you have obtained permission from any living person who is prominently identified, recorded, photographed, or otherwise featured in the submission, unless another lawful basis permits the Archive’s use of that material.
5. Moral Rights and Similar Rights
To the fullest extent permitted by applicable law, you waive and agree not to assert any moral rights, rights of attribution, rights of integrity, or similar rights that would prevent the Archive from exercising the rights granted under these Submission Terms.
Where such rights cannot legally be waived, you consent to the Archive’s exercise of the licensed rights to the fullest extent permitted by law.
6. Credit, Compensation, and Publication
Unless the Archive separately agrees otherwise in writing, you understand that:
- you will not receive payment, royalties, or other compensation for the submission or its use;
- the Archive may, but is not obligated to, provide attribution or credit;
- the Archive is not required to publish, display, preserve, or otherwise use any submission;
- the Archive may determine how, where, and for how long a submission appears; and
- the Archive may decline, restrict, or remove a submission at its discretion.
7. Personal Information and Privacy
In connection with your submission, the Archive may collect personal information, including your name, email address, location, biographical or family information, and any names, voices, images, likenesses, personal histories, or other identifying information contained in the submitted materials.
The Archive may use this information to evaluate, authenticate, organize, preserve, catalog, publish, display, promote, and administer the submission; communicate with you; respond to rights-related inquiries; maintain historical and archival records; and operate and protect the Archive.
Information provided with a submission may be shared with the Archive’s employees, contractors, website hosts, cloud-storage providers, researchers, cultural or educational partners, and other service providers or collaborators as reasonably necessary to operate the Archive and exercise the rights granted under these Submission Terms.
Because the Archive is operated in the United States and may use service providers located in the United States or other countries, personal information may be stored, accessed, or processed outside the contributor’s country of residence. Those countries may provide different privacy protections than the contributor’s home jurisdiction.
Certain information included in an accepted submission, including names, voices, images, likenesses, locations, family histories, and biographical or historical information, may be made publicly available as part of the Archive. You should not submit confidential, highly sensitive, or private information that you do not have authority to disclose or that you do not want preserved or potentially made public.
8. Responsibility for Your Submission
You are responsible for the materials you submit and for the accuracy of the representations you make under these Submission Terms.
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless the Archive and its directors, officers, employees, contractors, and representatives from third-party claims arising from your breach of these Submission Terms or your submission of materials that you were not legally authorized to provide.
9. Governing Law
These Submission Terms will be governed by the laws of the state of Wyoming and applicable United States federal law, without regard to conflict-of-law principles, except to the extent that mandatory laws in your country of residence apply and cannot legally be excluded.
If any portion of these Submission Terms is found unenforceable, the remaining provisions will remain in effect.
